Legal translation is the translation of texts that create, define or record legal rights and obligations – contracts, judgments, legislation, powers of attorney and official certificates. Because the translated text may be relied on by a court or authority, it must be precise, complete and faithful in effect, not just in wording. Here is what makes legal translation different and how professionals approach it.

Examples of legal texts

  • Contracts, terms and conditions and memoranda of understanding.
  • Court judgments, pleadings, expert reports and arbitration awards.
  • Laws, regulations and ministerial decrees.
  • Powers of attorney, affidavits and notarial deeds.
  • Company articles, resolutions and commercial register extracts.
  • Civil status documents used in legal proceedings: marriage, divorce, inheritance.

Why legal translation is different

General translation aims to convey meaning naturally. Legal translation must also preserve legal effect. Every party, obligation, condition, deadline and amount must be carried over exactly, and the structure – numbered clauses, definitions, cross-references – must stay intact so that the translation can be compared with the original line by line.

The main challenges

Different legal systems

Egypt has a civil-law system, with personal-status matters for Muslims governed by rules derived from Islamic law and separate rules for other communities. The United Kingdom and United States use common law. Concepts such as "trust", "consideration" or certain Egyptian personal-status terms have no exact equivalent in the other system, so the translator chooses the closest functional term and may add a brief explanation.

Fixed terminology

Legal language uses set phrases ("shall", "notwithstanding", "without prejudice") that carry specific meaning. Using an everyday synonym can change the obligation.

Ambiguity in the source

If the source is ambiguous, the translator should not resolve it silently. A professional flags the issue so the client's lawyer can decide.

Names, numbers and dates

Party names must match registrations or passports exactly; amounts in figures and words must agree; dates must be unambiguous.

Who should translate legal documents?

A translator with legal training or long legal experience, native-level command of the target language and knowledge of both legal systems – supported by a second linguist who revises the work. For documents submitted to authorities, the translation is usually certified by the translation office. Some countries require sworn or court-appointed translators for certain uses; check the receiving authority's rules.

Legal translation and legalisation

Translation and legalisation are separate. Legalisation confirms that a signature or seal on a document is genuine so it can be used abroad. Egypt is not a party to the Hague Apostille Convention, as confirmed by the official HCCH status table, so documents move between Egypt and other countries through consular legalisation.

Frequently asked questions

Is legal translation the same as certified translation?

Not exactly. Legal translation refers to the type of text; certified translation refers to the formal statement of accuracy. Many legal translations are also certified.

Can a general translator handle a contract?

It is risky. Contracts need a translator who understands legal terminology and effect, plus a second-linguist review.

Which version of a bilingual contract prevails?

Whichever the contract specifies. Include a language clause and have both versions checked before signing.

Do legal translators give legal advice?

No. They translate faithfully and may flag ambiguities, but advice must come from a lawyer.

Need a legal document translated?

Send the document and tell us where it will be used. COT's legal linguists will translate, review and certify it.
